Election
The MBCA meeting was called to order at 8:00 pm. Minutes from April 14, 2009 Beaches improvement meeting and Amended bylaws were available at meeting and online. Motion made by Rich to accept Joel seconded minutes.
Watershed Stewards Academy presented by Steve Fletcher and Pat Neidhart
A group of volunteers in AACO to learn more about the bay, make partnerships, find out how to make things happen. It included 9-10 weeks of course work. They have a proposal put together from their learning experience.
Pat – the last part of the training is to do a community project. The plan is a Family Fun Day – Magothy River Family Fun and Run Off and Explore your Watershed.
Steve’s daughter and Augie’s son are on the committee. Pat will be at beach with a seine net working with parents and kids. Steve will be at clubhouse with activates and watershed models. Will be held June 13 from 10AM-1PM. The author of My River Speaks, Marianne Taylor, will be there to tell stories. Recycle bins will be available and compost bins. They will be selling rain barrel kits from Arlington Echo for $30 (usually $100). Karl will be making hot dogs and burgers. The purpose of the event is to get the kids to become the catalyst to get more parents involved. Joel asked if the community could do something to help. They would like participation, set-up help, and maybe small amount if burgers and dogs not funded by Arlington Echo. Call or email

Other news:
Dumpsters will be in the community May 11-13. Chris Ronk needs volunteers, sign up on web site.

Old Business
Richard (Dick) McClelland discussed a neighborhood issue that impacts the community’s use of the waterfront near the boat ramp. He said that the community still owns rights to use the waterfront covenant (40 ft deep and about 150 feet across) to the left of the boat ramp. He said when the Marina took300 feet, there was still 150 feet left. The covenant for water use was not taken away when Platt #2 was revised. We still own right to use. A neighbor wants to construct a pier that has the potential to reduce our access to the waterfront. Dick thinks the community needs to take a position to defend our use.
Joel Stein asked who owns the house? Karl Neidhart said The Pleasant are the current owners (since 2007) and they have put up a no trespassing sign. Bill Venizelos is a neighbor to the Pleasants. The Pleasants are asking for riparian rights and wants him to take down his pier. The county and state said he didn’t need to remove it right now. A lawsuit has been filed.
Karl made a motion asking that the community draft a letter asking the Pleasants to take down the No Trespassing Sign and make claim for Riparian Rights for the community beach. Steve Fletcher seconds the motion. Dick will draft a letter to Paul Getske, the Circuit Court judge. Renee Layshock makes a motion asking that there be no costs associated with this letter. Karl asks for approval of NTE $750 for a Title company to review all the documents Dick has. He has deeds and paperwork dating back to the 1920’s. We want the title company to give us an opinion about the community rights. An estimate of 3 hours minimum at least $100 per hour. Renee withdraws her motion.
Rick says we have two separate motions so we need to deal with the first one.
The first motion made by Karl to draft a letter to the judge (Dick to draft) asking the Pleasant’s to remove the No trespassing sign (wit no cost to the community) is put to vote. 14 YES and 0 No’s.
The second motion about getting an opinion form a title company needs to have an estimate from a lawyer. $750 sounds to low. Keith Merryman suggests that a discretionary amount NTE $1,000 to be authorized by the President for a Title attorney to research all the documents and deeds that Dick has related to this matter. Dick has a Title Attorney who is supposed to be an expert in this area. Dennis Gossawhich???? Don Catterton makes a motion “that a discretionary amount NTE $1,000 to be authorized by the President for a Title attorney to research all the documents and deeds that Dick has related to this matter”. The vote is taken 23 YES, 0 no’s.
Permit in place to improve the development in front of the waterfront area in discussion. Aggie is already working on a permit from the Department of Environment.
Question Asked by Allison Fox if the problem with the Mandarin lawyer has ever been completed. Mike said no.
Elections
Mike apologizes that there was no nominating committee. Mike wants to step down as president. Question asked if anyone wants to be president. Rick Marsalek agrees to put his name out. No others come forth. Mike says he would be willing to trade places with Rick (Vice Pres.), he still wants to be involved, but not as the lead person.
- A vote is taken among the members present, 25 for Rick Marsalek as president, 0 No’s
- A vote is taken among the members present, 25 for Mike Frye as Vice President, 0 no’s
- Kate Holmes will continue as treasurer, she is unopposed.
- Renee Layshock will continue as secretary, she is unopposed.
- Board of Directors, Steve Fletcher s steeping down due to his new duties involved with stewardship. No new volunteer steps forth.
- Mike F makes a motion to keep all current board of directors excluding Steve, Vote was unanimous (25 yes, 0 no)
Mike Frye personally thanks Augie for all his time and effort
Rick M is looking for someone to take his place as a representative at the Greater Severna Park Council meetings, 2nd Tuesday of each month 7:30 – 9.
Karl N makes a motion to add the Watershed Steward position as a Committee chair position on the Board. No other discussion was made. 15 yeas, 0 neas. Steve Fletcher agrees to be the Watershed Chairman.
