Rick Marsalek called the MBCA meeting to order at 8:00 pm. 
 
Secretary’s Report- Minutes from May 5, 2009 meeting were available at meeting and online. Motion made by Rick to accept, Kate seconded. Rick mentioned the need to mail out a notice of the proposed schedule for general meetings and the general budget.

Richard (Dick) McClelland is still responding to issue about the community’s use of the waterfront near the boat ramp. He has not hired a title company but working on his own. 
 
Grant Permission-
Cypress Rd Beach Project-Augie Pasquale
 
The grant request to the Chesapeake Bay Trust was not funded. He has a rough plan on how to make our plan more appealing to the Bay Trust. The National Fish and Wildlife said that it was declined because the community contribution was not big enough, not that it wasn’t a good project. A new application was being prepared with a greater in kind cash contribution. The total project cost is $64,000. We are asking the trust for $35,000. MBCA is providing 23K in labor and backhoe costs and we have 1K from Unity Gardens. The county will be taking away the debris. If we add $10,000 in cash to our in kind work, this would put MBCA in a more favorable position. Augie said he discussed with the Bay Trust about submitting the application without funding approved by the community until the Sept vote.
 
Questions and comments: Karl Neidhardt raised a concern that if the $10K was not approved tonight and put in the application we would get kicked out again. Dave Maggio asked where the funds would come from. Kate Holmes responded that we have $13,300 in the boat ramp fund and $10,000 could be used from here and reimburse it with the Mandarin money as it comes in. Kate is concerned about the follow up of getting payments from Mandarin. We have been paid for 5 units of the proposed 21 units. 2 or 3 more homes have been sold. We get paid upon settlement. Rick has volunteered to follow up with Mandarin.
Dick McClelland wants to pursue a legal suit to get money from Mandarin. Rick and Rich Roys said we need to pursue other means before we consider any legal action. Kate Holmes stated that we did receive payments in Feb and April 2009. Rich May asked if the legal agreement with Mandarin states if there is a line item on the HUD/Settlement Sheet that could be added to pay Manhattan Beach, that way it would be done as part of the closing process. Rick to follow up on this. Allison Fox asked how we could move forward on $10K in new expenses when the Sussman $10K legal invoices have not been resolved.   
 
A motion was made by Mark Sheid that the MBCA membership agree to allow the Board to include $10,000 commitment for the Cypress Road Beach Project in the General Budget presented in Sept 09, thereby committing these funds. Dick McCelland 2nds the motion. A vote of 16 yeas, 0 opposed and 2 abstentions was made. The motion carried. Meeting was adjourned.
